Introduction :

In a recent development reported by the US-China Economic and Security Review Commission, Chinese companies are cleverly sidestepping new export restrictions to acquire cutting-edge chipmaking equipment, a crucial component in electronic device manufacturing, from the United States. This revelation, outlined in the commission’s 741-page annual report, sheds light on the challenges faced by the Biden administration in enforcing the October 2022 export curbs.

The Export Curbs :

The export curbs, implemented in October 2022, were designed to prevent Chinese chipmakers from accessing US chipmaking tools, and essential electronic device components, for the production of advanced semiconductors at the 14-nanometer node or below. Despite the intent of these restrictions, the report highlights a significant gap in enforcement.

Loopholes and Challenges :

The Commerce Department’s use of the 14-nanometer restriction limit has inadvertently created loopholes, allowing importers to claim equipment usage on older production lines. The limited capacity for end-use inspections further complicates the verification process, making it challenging to ensure the equipment, a pivotal electronic device component, is not being utilized for the production of more advanced chips.

Huawei’s 7-nanometer Chip :

The report also addresses the mystery surrounding Huawei’s ability to produce a sophisticated 7-nanometer chip for its Mate 60 Pro smartphone at China’s leading chipmaker, SMIC. Despite being added to trade restriction lists in 2019 and 2020, Huawei and SMIC seem to have found ways to obtain the necessary equipment, possibly predating the October 2022 rules or sourcing it from other international avenues.

International Cooperation and Stockpiling :

To counter China’s access to advanced chipmaking tools, the United States collaborated with allies Japan and the Netherlands. Both countries announced their restrictions on the export of this coveted technology, essential electronic device components. However, the report reveals that China stockpiled equipment during the lag time between the US rules in October 2022 and the similar moves by Japan and the Netherlands in July and September of 2023, respectively.

Trade Statistics :

Between January and August 2023, China imported a staggering $3.2 billion (RMB 23.5 billion) worth of semiconductor manufacturing machines from the Netherlands, reflecting a 96.1% increase from the same period in 2022. Overall, China’s imports of semiconductor equipment, and critical electronic device components, from all countries amounted to $13.8 billion (RMB 100 billion) over the first eight months of 2023.

Recommendations :

While the report does not provide specific recommendations to address the gaps in US rules, it strongly urges Congress to request an annual evaluation by the General Accountability Office within six months. This evaluation would assess the effectiveness of export controls on chipmaking equipment, a cornerstone in electronic device manufacturing, destined for China, and would be made public to enhance transparency.

As the US-China Economic and Security Review Commission unveils these findings, it becomes evident that navigating the complexities of export controls in the semiconductor industry, a vital sector in electronic device component manufacturing requires ongoing vigilance and international collaboration. The challenges outlined in the report underscore the need for adaptive policies to safeguard technological advancements and national security interests in electronic device components.
